Terms of Service

These terms apply when you use kushigrafixx.in or hire Kushi Grafixx for design work. Using the site or engaging our services means you accept them.
1. Who we are
Kushi Grafixx is the name under which Kushi Subrahmanya, an independent freelance brand identity designer based in Mangaluru, Karnataka, India, offers design services. It is a working name, not a registered company. Kushi works remotely with clients worldwide. In these terms, “we”, “us” and “our” mean Kushi Subrahmanya working as Kushi Grafixx, and “you” means the person or business using the site or our services.

2. How these terms fit with your proposal
Every client project starts with a written proposal, quote or agreement that sets out the scope, deliverables, timeline and price. If that document says something different from these terms, the proposal wins for that project. These terms cover everything the proposal does not.
3. Using the website
You may browse the site, read its content and use any free tools it offers for personal or business purposes. You agree not to:
- copy, republish or resell the site’s content, case studies or design work without written permission;
- attempt to break, overload, scrape or gain unauthorised access to the site or its systems;
- use the site for anything unlawful, or to send spam or malicious code;
- submit information through our forms that is false or that you have no right to share.
4. Free tools
From time to time the site may offer free design tools, such as generators for patterns, textures or naming ideas. Output you create with them is yours to use, including commercially. The tools are provided as they are, with no promise that they will always be available or error-free. You are responsible for checking that names, words or designs you take from them do not infringe anyone else’s trademark or other rights.
5. Enquiries, calls and onboarding
Booking a call, sending an enquiry or completing the onboarding form does not create a contract. A project begins only when you accept a proposal in writing and pay any deposit it requires.
You confirm that the information and files you give us are accurate, and that you have the right to share them with us for the project.
6. Scope and changes
The proposal defines what is included. Work outside it, such as extra deliverables, additional concepts or a change of direction after approval, is quoted separately and starts once you agree to the extra cost and time.
7. Revisions
Revision rounds are included as stated in your proposal. A revision refines the agreed direction. Starting over on a new direction after a stage has been approved is a change of scope under section 6.
8. Timelines and your part
Timelines in a proposal are estimates that depend on you providing content, feedback and approvals on time. Delays on your side move the delivery date by at least the same amount. If we hear nothing for 30 days despite reminders, we may treat the project as paused and invoice for the work completed. Restarting a paused project depends on our availability.
9. Fees and payment
- Prices are project-based and stated in your proposal. The amount quoted is the amount you pay, unless the scope changes.
- The deposit, payment stages and due dates are as stated in your proposal and invoices.
- Taxes that apply by law are added where required and shown on the invoice. Bank, transfer and currency conversion charges are yours to bear.
- If an invoice is overdue, we may pause work and hold back files until it is paid.
- Final files and the rights described in section 11 are released once the project is paid in full.
10. Cancellation and refunds
Either of us may end a project by giving written notice. If a project ends early:
- you pay for all work completed up to the date of notice;
- the deposit is non-refundable once work has started, because it reserves time and covers the initial strategy and concept work;
- any amount paid beyond the work completed is refunded;
- rights transfer only for work that has been paid for in full.
Because the work is custom-made, completed and delivered work is not refundable.
11. Who owns the work
Final deliverables. Once you have paid in full, you own the final approved deliverables described in your proposal, and may use them without limit.
Unused concepts. Preliminary ideas, sketches, alternative directions and concepts you did not select remain ours, and may not be used without a separate agreement.
Our tools and methods. We keep ownership of our working methods, templates, processes and know-how, including anything we created before or independently of your project.
Third-party materials. Fonts, stock images, icons, software and similar items are owned by their makers and governed by their own licences. We will tell you which ones your project uses. Buying and keeping the right licences is your responsibility unless your proposal says we will do it.
12. Showing the work
We may show the finished work, and describe our role in it, in our portfolio, case studies, social media and award entries. If your project is confidential or not yet public, tell us in writing before the project starts and we will hold it back until you clear it, or keep it private altogether.
13. What you provide
You confirm that you own or have permission to use everything you give us, including logos, text, photos and data. If a third party makes a claim against us because of material you supplied, you agree to cover the resulting costs.
14. Trademark and legal checks
We design with originality in mind and do not knowingly copy anyone’s work. We do not carry out trademark searches or offer legal clearance. Before you register or launch a name, logo or identity, you are responsible for having it checked and registered by a qualified professional.
15. Confidentiality
Each of us will keep the other’s non-public business information confidential and use it only for the project. This does not apply to information that is already public, that was already known to the receiving side, or that the law requires to be disclosed.
16. Human-led design
Every project is led, designed and finished by a human designer. The strategy, the ideas and every creative decision are ours. AI-assisted tools are used only as assistants for supporting tasks such as research and early exploration, never as a substitute for the designer’s judgement or craft, and nothing reaches you without being shaped and approved by hand. If your project must avoid AI tools altogether, tell us before it starts.
17. No guarantee of results
Good design supports a business; it cannot promise one. We do not guarantee specific commercial outcomes such as sales, funding, rankings or audience growth. The website, its content and its tools are provided as they are.
18. Limit of liability
To the fullest extent the law allows:
- our total liability for any claim connected to a project is limited to the fees you paid us for that project;
- our total liability for use of the website or its free tools, where no fees were paid, is limited to INR 5,000;
- neither of us is liable to the other for indirect or consequential loss, such as lost profit, lost revenue or lost data.
Nothing in these terms limits liability that cannot be limited by law.
19. Links and outside services
The site links to services run by others, such as Cal.com for booking and WhatsApp for messaging. We do not control those services and are not responsible for their content or practices. Their own terms apply when you use them.
20. Events outside our control
Neither of us is responsible for delay or failure caused by events beyond reasonable control, such as illness, natural disasters, power or internet outages, or government action. We will tell each other promptly and agree a new timeline.
21. Governing law and disputes
These terms are governed by the laws of India. If a disagreement arises, we will first try to settle it by talking in good faith for at least 30 days. After that, the courts in Mangaluru, Karnataka have exclusive jurisdiction.
22. Changes to these terms
We may update these terms from time to time. The current version and the date it was last updated are always on this page. A project already under way continues under the terms that applied when its proposal was accepted.
